The rules of using AI Pet Generator

1. Who we are

AI Pet Generator is operated by the AI Pet Generator team. Contact us at support@aipetgenerator.app.

2. Eligibility and accounts

• You must be at least 16 and legally able to form a contract.
• You are responsible for your account credentials. Keep them secure and notify us of unauthorized use.
• Authentication is provided by Clerk; your use must also comply with their terms.

3. Your content

• You retain ownership of prompts, uploads, and outputs you create, subject to any third-party rights in source material.
• You grant us and our processors a limited license to process and host your content to operate the service, improve safety, and comply with law.
• Do not upload content you lack rights to or that violates law, privacy, or intellectual property.

4. Acceptable use

• No illegal, harmful, hateful, or violent content.
• No attempts to re-identify individuals, create misleading deepfakes, or violate privacy.
• No exploitation of minors or sensitive subjects; no harassment or abuse.
• No interference with service integrity (e.g., rate abuse, scraping, security testing without consent).
• No infringing use of trademarks, copyrights, or publicity rights.

5. AI outputs and reliability

• Outputs are generated by AI and may be imperfect or unexpected.
• You are responsible for reviewing outputs before use and ensuring they are lawful and appropriate.
• We do not guarantee exclusivity or originality of AI outputs; similar prompts may yield similar results.

6. Credits, billing, and refunds

• Certain features use credits. Prices, bundles, and expirations are shown in-app.
• Payments are handled by third-party processors. Taxes may apply based on your location.
• Except where required by law, purchases and used credits are non-refundable. If we materially fail to deliver, contact support and we will work with you.

7. Third-party services

We rely on trusted vendors such as Clerk (authentication), OpenAI and Replicate (generation), hosting/CDN providers, and payment processors. Their terms may apply where you interact with them.

8. Suspension and termination

• We may suspend or terminate accounts for violations of these Terms, legal requirements, or security reasons.
• You may stop using the service at any time; request account closure by contacting support.
• Upon termination, your right to access the service ends. Sections that should reasonably survive will continue (e.g., IP ownership, disclaimers, limits of liability).

9. Disclaimers

The service is provided “as is” and “as available.” To the fullest extent allowed by law, we disclaim warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, or reliability. We do not guarantee that outputs will meet your expectations or that the service will be uninterrupted or error-free.

10. Limitation of liability

To the maximum extent permitted by law, our total liability for claims arising out of the service is limited to the greater of (a) amounts you paid to us in the 6 months before the claim or (b) USD $50. We are not liable for indirect, special, incidental, consequential, or punitive damages, or loss of data, profits, or goodwill.

11. Indemnity

You agree to defend and indemnify us against third-party claims arising from your unlawful content, misuse of the service, or breach of these Terms.

12. Changes to the service or Terms

We may update features or these Terms. We will post changes here and, when changes are material, notify you through the app or email. Continued use after changes means you accept them.

13. Governing law and disputes

These Terms are governed by the laws of your country of residence if mandatory law requires; otherwise, they are governed by the laws of the United States and the State of Delaware, excluding conflict-of-law principles. Courts in Delaware will have jurisdiction where permitted.
